  1. The Microsoft Imaging Software for Windows 95 software is considered part
  2.  of Microsoft Windows 95 operating system software.  Therefore, its use
  3.  is subject to the same terms and conditions which govern the use of
  4.  Microsoft Windows 95 operating system.  A copy of such terms and
  5.  conditions is attached below for your convenience.

  7.              END-USER LICENSE AGREEMENT FOR
  8.         MICROSOFT IMAGING SOFTWARE for WINDOWS 95
  9.  
  10. IMPORTANT READ CAREFULLY: This Microsoft End-User License
  11.  Agreement (EULA) is a legal agreement between you (either an individual
  12.  or a single entity) and Microsoft Corporation for the Microsoft software
  13.  product identified above, which includes computer software and
  14.  associated media and printed materials, and may include online or
  15.  electronic documentation (SOFTWARE PRODUCT or SOFTWARE). By
  16.  installing, copying, or otherwise using the SOFTWARE PRODUCT,
  17.  you agree to be bound by the terms of this EULA. If you do not agree
  18.  to the terms of this EULA, promptly return the unused SOFTWARE
  19.  PRODUCT to the place from which you obtained it for a full refund.
  20.  
  21. SOFTWARE PRODUCT LICENSE
  22.  
  23. The SOFTWARE PRODUCT is protected by copyright laws and international
  24.  copyright treaties, as well as other intellectual property laws and
  25.  treaties. The SOFTWARE PRODUCT is licensed, not sold.
  26.  
  27. 1. GRANT OF LICENSE. This EULA grants you the following rights:
  28. ｷ Systems Software. You may install and use one copy of the SOFTWARE
  29.   PRODUCT on a single computer. If the SOFTWARE PRODUCT includes
  30.   functionality that enables your single computer to act as a network
  31.   server, any number of computers or workstations may access or otherwise
  32.   utilize the basic network services of that server. The basic network
  33.   services are more fully described in the printed materials accompanying
  34.   the SOFTWARE PRODUCT.
  35. ｷ Storage/Network Use. You may also store or install a copy of the
  36.   SOFTWARE PRODUCT on a storage device, such as a network server,
  37.   used only to install or run the SOFTWARE PRODUCT on your other
  38.   computers over an internal network; however, you must acquire and
  39.   dedicate a license for each separate computer on which the SOFTWARE
  40.   PRODUCT is installed or run from the storage device. A license for
  41.   the SOFTWARE PRODUCT may not be shared or used concurrently on
  42.   different computers.
  43. ｷ License Pak. If you have acquired this EULA in a Microsoft License Pak,
  44.   you may make the number of additional copies of the computer software
  45.   portion of the SOFTWARE PRODUCT authorized on the printed copy of this
  46.   EULA, and you may use each copy in the manner specified above.

  48. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS. 
  49. ｷ Limitations on Reverse Engineering, Decompilation, and Disassembly.
  50.   You may not reverse engineer, decompile, or disassemble the
  51.   SOFTWARE PRODUCT, except and only to the extent that such activity
  52.   is expressly permitted by applicable law notwithstanding this limitation.
  53. ｷ Separation of Components. The SOFTWARE PRODUCT is licensed as a
  54.   single product. Its component parts may not be separated for use on
  55.   more than one computer.
  56. ｷ Rental. You may not rent or lease the SOFTWARE PRODUCT. 
  57. ｷ Software Transfer. You may permanently transfer all of your rights under
  58.   this EULA, provided you retain no copies, you transfer all of the
  59.   SOFTWARE PRODUCT (including all component parts, the media and
  60.   printed materials, any upgrades, this EULA and, if applicable, the
  61.   Certificate of Authenticity), and the recipient agrees to the terms of
  62.   this EULA. If the SOFTWARE PRODUCT is an upgrade, any transfer must
  63.   include all prior versions of the SOFTWARE PRODUCT.
  64. ｷ Termination. Without prejudice to any other rights, Microsoft may
  65.   terminate this EULA if you fail to comply with the terms and conditions
  66.   of this EULA. In such event, you must destroy all copies of the SOFTWARE
  67.   PRODUCT and all of its component parts.

  69. 3. UPGRADES. If the SOFTWARE PRODUCT is an upgrade from another
  70.   product, whether from Microsoft or another supplier, you may use or
  71.   transfer the SOFTWARE PRODUCT only in conjunction with that upgraded
  72.   product, unless you destroy the upgraded product. If the SOFTWARE
  73.   PRODUCT is an upgrade of a Microsoft product, you now may use that
  74.   upgraded product only in accordance with this EULA. If the SOFTWARE
  75.   PRODUCT is an upgrade of a component of a package of software programs
  76.   that you licensed as a single product, the SOFTWARE PRODUCT may be
  77.   used and transferred only as part of that single product package and
  78.   may not be separated for use on more than one computer.
  79.  
  80. 4. COPYRIGHT. All title and copyrights in and to the SOFTWARE PRODUCT
  81.   (including but not limited to any images, photographs, animations,
  82.   video, audio, music, text, and applets, incorporated into the SOFTWARE
  83.   PRODUCT), the accompanying printed materials, and any copies of the
  84.   SOFTWARE PRODUCT, are owned by Microsoft or its suppliers. The
  85.   SOFTWARE PRODUCT is protected by copyright laws and international
  86.   treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT
  87.   like any other copyrighted material except that you may either (a) make
  88.   one copy of the SOFTWARE PRODUCT solely for backup or archival
  89.   purposes, or (b) install the SOFTWARE PRODUCT on a single computer
  90.   provided you keep the original solely for backup or archival purposes.
  91.   You may not copy the printed materials accompanying the SOFTWARE
  92.   PRODUCT.

  94. 5. DUAL-MEDIA SOFTWARE. You may receive the SOFTWARE PRODUCT
  95.   in more than one medium. Regardless of the type or size of medium you
  96.   receive, you may use only one medium that is appropriate for your
  97.   single computer.  You may not use or install the other medium on
  98.   another computer. You may not loan, rent, lease, or otherwise transfer
  99.   the other medium to another user, except as part of the permanent
  100.   transfer (as provided above) of the SOFTWARE PRODUCT.

  102. 6. U.S. GOVERNMENT RESTRICTED RIGHTS. The SOFTWARE PRODUCT
  103.   and documentation are provided with RESTRICTED RIGHTS. Use,
  104.   duplication, or disclosure by the Government is subject to restrictions
  105.   as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data
  106.   and Computer Software clause at DFARS 252.227-7013 or subparagraphs
  107.   (c)(1) and (2) of the Commercial Computer Software Restricted Rights at
  108.   48 CFR 52.227-19, as applicable. Manufacturer is Microsoft Corporation/
  109.   One Microsoft Way/Redmond, WA 98052-6399.

  111. MISCELLANEOUS
  112. If you acquired this product in the United States, this EULA is governed by
  113.  the laws of the State of Washington. 
  114.  
  115. If you acquired this product in Canada, this EULA is governed by the laws
  116.  of the Province of Ontario, Canada. Each of the parties hereto irrevocably
  117.  attorns to the jurisdiction of the courts of the Province of Ontario and
  118.  further agrees to commence any litigation which may arise hereunder in the
  119.  courts located in the Judicial District of York, Province of Ontario. 
  120. If this product was acquired outside the United States, then local law may
  121.  apply.

  128. LIMITED WARRANTY
  129. LIMITED WARRANTY. Microsoft warrants that (a) the SOFTWARE
  130.  PRODUCT will perform substantially in accordance with the accompanying
  131.  written materials for a period of ninety (90) days from the date of
  132.  receipt, and (b) any hardware accompanying the SOFTWARE PRODUCT will
  133.  be free from defects in materials and workmanship under normal use and
  134.  service for a period of one (1) year from the date of receipt. Some
  135.  states and jurisdictions do not allow limitations on duration of an
  136.  implied warranty, so the above limitation may not apply to you. To the
  137.  extent allowed by applicable law, implied warranties on the SOFTWARE
  138.  PRODUCT and hardware, if any, are limited to ninety (90) days and one
  139.  year, respectively.

  141. CUSTOMER REMEDIES. Microsoft痴 and its suppliers entire liability and
  142.  your exclusive remedy shall be, at Microsoft痴 option, either (a) return
  143.  of the price paid, or (b) repair or replacement of the SOFTWARE PRODUCT
  144.  or hardware that does not meet Microsoft痴 Limited Warranty and which is
  145.  returned to Microsoft with a copy of your receipt. This Limited Warranty
  146.  is void if failure of the SOFTWARE PRODUCT or hardware has resulted from
  147.  accident, abuse, or misapplication. Any replacement SOFTWARE PRODUCT
  148.  or hardware will be warranted for the remainder of the original warranty
  149.  period or thirty (30) days, whichever is longer. Outside the United States,
  150.  neither these remedies nor any product support services offered by
  151.  Microsoft are available without proof of purchase from an authorized
  152.  international source.

  154. NO OTHER WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY
  155.  APPLICABLE LAW, MICROSOFT AND ITS SUPPLIERS DISCLAIM ALL
  156.  OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING,
  157.  BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY
  158.  AND FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO THE
  159.  SOFTWARE PRODUCT, AND ANY ACCOMPANYING HARDWARE. THIS
  160.  LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU
  161.  MAY HAVE OTHERS, WHICH VARY FROM STATE/JURISDICTION TO
  162.  STATE/JURISDICTION.
  163. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. TO THE MAXIMUM
  164.  EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL
  165.  MICROSOFT OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL,
  166.  INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES
  167.  WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES
  168.  FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION,
  169.  LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY
  170.  LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE
  171.  THE SOFTWARE PRODUCT, EVEN IF MICROSOFT HAS BEEN
  172.  ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE
  173.  SOME STATES AND JURISDICTIONS DO NOT ALLOW THE
  174.  EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL
  175.  OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT
  176.  APPLY TO YOU.
